Terms of Sale
Article 1 — Purpose
These terms of sale govern the sale of digital visibility and growth services (followers, likes, views, reviews, comments, streams, members, traffic, SEO) offered on vyboost.com ("VyBoost") to any individual or legal entity (the "Customer").
Placing an order on the site implies unconditional acceptance of these terms of sale, which take precedence over any other document. These terms of sale are governed by French law, regardless of the language in which the site is browsed.
Article 2 — Services
VyBoost offers digital growth services for various platforms (Instagram, TikTok, YouTube, Facebook, X, and other platforms listed on the site). The details, features and prices of each service are shown on the corresponding product page before any order is placed.
Services are delivered based on the link or username provided by the Customer. VyBoost never asks for or stores the Customer's social media login credentials.
Article 3 — Price
Prices are shown in euros (€), including any applicable taxes, and are publicly displayed on each product page before any account creation or order. VyBoost reserves the right to change its prices at any time; the price applied is the one in effect when the order is confirmed.
Article 4 — Order
To place an order, the Customer selects a service and quantity, provides the relevant link or username, then proceeds to payment. A VyBoost account is required to place an order and track its progress.
The order is only final once payment is confirmed. A confirmation email is sent to the Customer at that point.
Article 5 — Payment
Payment is made in a single transaction, by card, via the secure payment platform Stripe. VyBoost never stores the Customer's banking details. Orders are never linked to a subscription or recurring charge.
Article 6 — Execution and delivery time
The services offered are intangible services delivered electronically. Processing starts automatically once payment is confirmed. Delivery time ranges from 10 minutes to 24 hours maximum depending on the service ordered, as stated on each product page.
The Customer can track order progress from their "My account" dashboard.
Article 7 — Right of withdrawal
Under Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for service contracts fully performed before the end of the withdrawal period, where performance began with the consumer's prior express agreement and express waiver of their right of withdrawal.
By ticking the box provided at checkout, the Customer expressly requests immediate execution of their order and acknowledges losing their right of withdrawal once the service has been fully performed.
If execution of the service has not yet begun, the Customer has 14 days to exercise their right of withdrawal by contacting VyBoost via the contact form.
Article 8 — Liability
VyBoost undertakes a best-efforts obligation in providing its services. Results may vary depending on factors beyond VyBoost's control, in particular the policies and algorithms of third-party platforms (Instagram, TikTok, YouTube...), whether the relevant account is public or private, or any action taken by the Customer during order execution (deleting the relevant content, switching the account to private, etc.).
VyBoost cannot be held liable for the suspension, restriction or closure of an account by a third-party platform, as such decisions are governed exclusively by that platform's own terms of use.
Article 9 — Complaints and customer service
For any question or complaint regarding an order, the Customer may contact customer service via the contact form or by email at contact@vyboost.com. VyBoost undertakes to respond as promptly as possible.
Article 10 — Consumer mediation
Under Articles L616-1 and R616-1 of the French Consumer Code, in the event of a dispute not resolved directly with customer service, the Customer may use a consumer mediation service free of charge. The details of the competent mediator will be published on this page once designated.
Article 11 — Personal data
The processing of the Customer's personal data in connection with their order is described in our privacy policy.
Article 12 — Applicable law and jurisdiction
These terms of sale are governed by French law. In the event of a dispute, and failing an amicable resolution or mediation, French courts shall have exclusive jurisdiction.
